A Shopping Agreement is one of the first agreements used in acquiring source material from the creator. It’s typically used between a Producer and Writer, but the parties can vary depending on the project. The Agreement gives the acquiring party (i.e. Producer) a certain amount of time (usually exclusive) to “shop” the project to gain third-party investors, developers, studios, or production companies to come on board. If successful, then the parties will further negotiate with that third-party in a separate contract.
This template treats both parties equally without giving strong deference to either side.
